2. Since no adverse order is going to be passed against the respondent, notice to him is dispensed with.

3. The respondent herein filed a suit in OS.No.322 of 2019 seeking recovery of money and it was decreed exparte. The petitioner herein filed I.A.No.2 of 2023 to set aside the exparte decree passed against him on 24.03.2020. The said application has been simply adjourned without any progress. Therefore, the petitioner has come before this court.

A perusal of the petition order in I.A.No.2 of 2023 would indicate that in the petition to set aside the exparte decree, the respondent filed counter only on 25.08.2025 and after several adjournments, petitioner side was heard on 19.01.2026. The matter has been simply adjourned for hearing respondent side from time to time for the past 9 months.

4. Taking into consideration that the instant application was filed in the year 2023 and the petitioner’s side was heard as early as on 19.01.2026, the Trial court is directed the Trial Court to dispose of I.A.No.2 of 2023 in O.S.No.322 of 2019 as expeditious as possible, preferably within a period of eight (8) weeks from the date of receipt of copy of the order. __________
