Judgment
(Judgment of the Court was delivered by N.Sathish Kumar J.) Challenge has been made to the order dated 14.08.2023 passed by the learned Single Judge allowing the application in A.No.2407 of 2023 in C.S.No.81 of 2013, which has been filed seeking for a direction to the respondents therein / appellants herein to deposit the suit amount of Rs.1,25,67,470/- or to furnish security to the tune of suit amount, failing which to attach the schedule property.
2. When the matter is taken up for hearing, it is submitted by both sides that during the appeal proceedings on 03.11.2023, a status quo order was passed and both the parties were directed to maintain status quo. Now, it is fairly submitted by both learned counsel that the suit is in the fag end and it is now posted for defendants’ side evidence. In such view of the matter, this court is of the view that no prejudice would be caused to the parties if the status quo order is directed to continue till the disposal of the suit. Accordingly, this original side appeal is disposed of with a direction to both parties to maintain status quo till
