Judgment

(Judgment of the Court was delivered by N.Sathish Kumar J.) A challenge has been made to the order passed by the learned single Judge in O.A.No.873 of 2026, granting interim injunction in section 9 application, inter-alia restraining the appellant from interfering with the possession of the respondent herein.

2. When the matter is taken up for hearing, the learned counsel for the respondent submitted that he has already filed a petition in Arb.O.P. (Commercial Division) No.734 of 2026 under section 11 of the Arbitration and Conciliation Act, 1996 for the appointment of an arbitrator. This court is of the view that since arbitration proceedings has been invoked, the matter shall be resolved by arbitration. The only contention raised by the learned counsel for the appellant is that after the inventory has been taken by the advocate commissioner, the construction utensils were also used by the respondent. Since the matter has been referred to the arbitration, the appellant can raise all such disputes as a counter claim in the arbitral proceedings. In such view of the matter, nothing further survives in the appeal. With the aforesaid observation,
