ORDER

Though the learned counsel for the petitioner would contend that the

WP No. 11443 of 2024

petitioner is entitled for a Selection Grade scale of Chief Head Warder Pay with effect from 01.07.2006, the same was totally objected by the learned Special Government Pleader.

2. Learned Special Government Pleader would contend that the petitioner was retired from service on 30.06.2010 and that the present claim is with effect from 01.07.2006, hence the claim is vitiated by delay and laches. It is his further submission that notwithstanding the merit, when there is a huge delay, this court can deny the issuance of Mandamus.

3. I have given my anxious consideration to the submissions made on either side.

4. Looking into the factual position, it is seen that the petitioner has retired from services on 30.06.2010. However, the present writ petition has been filed after a period of 14 years from the date of his retirement claiming Selection Grade pay with effect from 01.07.2006 viz. 20 years from today. Therefore, as rightly contended by the learned Special Government Pleader, notwithstanding the fact that the petition is liable to be dismissed in limine on the ground of delay and laches. In this regard, it is relevant to refer the decision of the Hon’ble Supreme Court in the case of State of M.P. vs Nandlal Jaiswal, reported in (1986) 4 SCC 566.
