(Order of the Court was made by S.M.Subramaniam J.) The present writ petition has been instituted to direct the respondents 2 to 6 herein to remove the encroachment and construction made by the 7th respondent in S.No.82/5 measuring an extent of 16.8 cents situated at

Pinjanur village, Edachittur post, veppur Taluk, Cuddalore District by consider the representation dated 14.7.2025.

2. In the context of the relief sought for in the writ petition, the learned Special Government Pleader based on the written instructions by Tahsildar, Veppur dated 08.10.2026 would submit that the revenue authorities conducted the survey and identified encroachments. Thus, the authorities will initiate enforcement action by following the procedures.

3. Learned counsel for the 7th respondent would submit that the subject land is a patta land. However, in this regard the revenue authorities have to conduct an enquiry.

4. In view of the facts and circumstances, the respondents 1 to 4 are directed to proceed with the enforcement action based on the survey conducted and by following the procedures as contemplated under the relevant statutes and rules, encroachments are to be removed. The 7th respondent is at liberty to submit all the documents available with him to the revenue authorities, who in turn shall consider the same. The revenue authorities, while conducting enquiry, shall afford opportunity to the 7th respondent to place his documents. In this regard, notice also may be issued

to the 7th respondent. After conducting enquiry, further proceedings are to be initiated by issuing final notice for removal of encroachments. The entire exercise is directed to be completed within a period of twelve weeks from the date of receipt of a copy of this order. The writ petition is disposed of accordingly. No costs. (S.M.S.,J.)
