3. The petitioner submits that due to a serious property dispute and threats to life, they were unable to operate the outlet from 10.05.2026. Subsequently, the petitioner filed W.P. (Crl.) No. 1054 of 2026 seeking police protection, wherein this Court passed a status quo order on 05.06.2026. The petitioner thereafter cleared all outstanding dues and made advance payments for the supply of petroleum products. Despite this, the respondents appointed ad-hoc dealers to operate the petitioner’s outlet without providing any notice or conducting an enquiry. Consequently, the petitioner has approached this Court .

4. Mr. Mohamed Fayaz Ali, learned Standing Counsel on instructions would submit that the petitioner has been provided with an undertaking-cum- indemnity affidavit. If the petitioner approaches the 2nd respondent along with this affidavit, the parties can sit across the table, negotiate and thereafter orders for the petitioner operating the retail outlet would be passed. He would also submit that the petitioner shall approach the respondent on 19.10.2026.

5. It is further informed that the respondents are proposing to appoint Ad- hoc dealers. However, he has not taken possession of the retail outlet.

6. Therefore, till the parties arrive at a conclusion, the order appointing an ad hoc dealer shall not be given effect. In the event of the petitioner not willing

to abide by the conditions that would be imposed, he shall not stand in the way of the subsequent dealer taking over the outlet.
