Common Order

(Order of the Court was made by S.M.Subramaniam J.) Writ Petition No.4642 of 2026 has been instituted to direct the first respondent to implement the order passed by the 2nd respondent in Na.Ka.A3/ 77/ 2025 dated 5.12.2025 to first respondent in accordance with law.

2. Writ Petition No.23207 of 2026 has been instituted for forbearing the 2nd respondent from interfering with petitioners peaceful possession and enjoyment of S.No.28/10B4 0.01.0 are in Ramanatham Village, Thittakudi Taluk, Cuddalore District till the disposal of the appeal dated 09.02.2026 field before the Collector, Cuddalore Dsitrict i.e., except by following due procedure established by law.

3. A perusal of the said order would show that it is an inter-departmental communication between the Block Development Officer and Revenue Tahsildar. Such a communication would not create a cause of action for institution of a writ petition. It is only a communication between the Government departments.

3. Learned counsel for the third respondent as well as the learned Government Advocate appearing for the first respondent would submit that the District Collector, Cuddalore conduct a detailed enquiry in the appeal filed by the third respondent under Section 10 of the Tamil Nadu Land Encroachment Act. The District Collector conducted elaborate enquiry by affording opportunity to all the parties and pass an order stating that the third respondent is the Patta holder of the land.

4. In view of the fact that Section 10 appeal filed by the third respondent came to be allowed by the District Collector, the writ petition is devoid of merits and hence stands dismissed. No costs.

5. In view of the order passed in W.P.No.4642 of 2026, no further orders are required in W.P.No.23507 of 2026 and the same is closed. No costs. Consequently, connected miscellaneous petition is closed.
