Ajay Mohan Goel, Judge (Oral) CMP No.2438 of 2026 By way of this application filed by the State, a prayer has been made for modification of order dated 19.06.2024, inter alia, on the ground that this petition was disposed of in light of the judgment passed in CWP No.4586 of 2023 titled Tika Ram vs. State of H.P. and another, along with connected matters, decided on 21.05.2024 and the said judgment was based on the earlier judgments including the judgment passed in CWP No.2108 of 2023, titled Bhagat Ram Versus Himachal Road Transport Corporation and others, which stood re-called.

2. When this case was listed on 25.09.2026, the following order was passed:- “CMP No. 2438 of 2026 Learned Assistant Advocate General to have instructions

Whether reporters of the local papers may be allowed to see the judgment?

as to whether any review or modification of the order has been sought by the State in CWP No. 4586 of 2023, titled as Teeka Ram versus State of HP and others, on the basis whereof, the present petition was disposed of. Let needful be done by the next date of hearing. List on 9th of October, 2026.”

Today, learned Additional Advocate General apprised the Court that LPA No. 224 of 2026, which was filed by the State against the judgment of the learned Single Judge in Tika Ram's case, has been allowed by the Hon’ble Division Bench on 22.04.2026 and the writ has been restored to its original position and has been ordered to be heard along with CWP No. 2108 of 2023, titled Bhagat Ram Versus. Himachal Road Transport Corporation and others. He further submitted that as far as the case titled Bhagat Ram Versus. Himachal Road Transport Corporation and others is concerned, in the said case, Hon’ble Division Bench of this Court has already heard the arguments and judgment is reserved.

Learned counsel for the non-applicant/writ petitioner submits that in light of these developments, the order passed by this Court may be recalled, but with the observation that after the adjudication in Bhagat Ram's case, appropriate orders be passed in the case of the present petitioner also by the Authority concerned within some reasonable time.

5. In light of the fact situation as has been enumerated above, as also the prayer made by the learned Counsel for the non- applicant/writ petitioner, this application is allowed by re-calling

order dated 19.06.2024, by further ordering that the writ be restored to its original number. CWP No.10105 of 2023

6. As agreed, this petition is disposed of with the direction that the appropriate Authority shall take a call in the case of the petitioner in terms of the prayers made therein within 12 weeks as from the date of the decision by this Court in CWP No. 2108 of 2023, titled Bhagat Ram Versus. Himachal Road Transport Corporation and others. Pending miscellaneous application(s), if any, also stand disposed of accordingly.
