ORDER
Heard learned counsel appearing for the petitioner and the learned Special Government Pleader appearing for the 1st Respondent.
2. Since no adverse order is going to be passed against the 2nd respondent, notice to him is dispensed with.
WP(MD) No. 29718 of 2026
3. The present Writ Petition has been filed seeking the issuance of a writ of mandamus directing the 1st respondent to conduct an enquiry based on the objection petition dated 07.09.2026 submitted by the petitioner before the registration of the document presented by the 2nd respondent.
4. It is the case of the petitioner that the property belonging to her husband is being attempted to be dealt with by the 2nd respondent, her son, without reference to her. She would further submit that the 2nd respondent, who is her son, is not taking care of her and that, in such circumstances, her substantial rights in the property would be denied by the 2nd respondent.
5. The registering authority under the Registration Act can refuse registration only under the provisions of Section 22-A of the Act or if it finds that the executant does not have title to the property. In such circumstances, it would be appropriate for the petitioner to approach the Civil Court to obtain appropriate relief and she cannot expect the registering authorities to adjudicate the title to the property. In that regard, this Court is of the view that the writ of mandamus, as prayed for by the petitioner, cannot be granted.
WP(MD) No. 29718 of 2026
6. Accordingly, the Writ Petition stands dismissed, granting liberty to the petitioner to approach the competent Civil Court for appropriate relief in respect of her grievance. There shall be no order as to costs. 15-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No Nsr To:
