PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, calling for the records on the file of the file of the 1st respondent’s proceedings in Na.Ka.No.7180/2021/E2 dated 26.07.2022 and quash the same and to fix sum of Rs.1092 as compensation in 1 sq.metre fixed to the petitioner’s land in Survey Nos.64, 65/3, 65/4 and 65/5 to an extent of 15579 sq.metre situated in Nadumandalam Village, Natham Taluk, Dindigul District acquired lands and the similar compensation is fixed in Survey No.65/4A1 and other Survey Nos of the acquired land in same Notification.

ORDER
The present Writ Petition has been filed in the nature of a Writ of Certiorarified Mandamus challenging the impugned proceedings, dated 26.07.2026 and for consequential reliefs.

Heard Mr.M.Venkatesan learned Counsel for the petitioners, Mr.S.Venkatesh, learned Additional Government Pleader, who takes notice on behalf of the respondents 1 and 3 to 5 and Mr.P.Karthick, learned Counsel, who takes notice on behalf of the second respondent. By consent of all parties, the Writ Petition is taken up for final disposal at the admission stage itself.

A perusal of the impugned proceedings would indicate that the said proceedings had been passed by the first respondent as an Arbitrator under the provisions of the National Highways Act, 1956, against which, only a petition under Section 34 of the Arbitration and Conciliation Act, 1996, could be maintainable and it could not be challenged by way of a Writ Petition under Article 226 of Constitution of India.

In such view of the matter, the Writ Petition fails and is accordingly dismissed, however, with liberty to the petitioners to challenge the impugned proceedings under Section 34 of the Arbitration Conciliation Act, 1996.
