ORDER

Pursuant to the judgment in O.S. No. 13 of 2019 on the file of the Special Judge, TNPID Court, Madurai, the immovable asset of the petitioner was attached. Thereafter, steps were taken to bring the immovable asset for sale. Communication dated 01.10.2026 is challenged in this Writ Petition on the ground that the upset price is much lower than the market price.

WP(MD) No. 29939 of 2026

2. According to the petitioner, the market rate for the land is about Rs.90,00,000/- per acre. Reliance is placed on a valuation report in this regard.

3. Accepting notice for respondents 1 to 4, Mr. P.Pethu Rajesh, learned Additional Government Pleader, submits that the petitioner failed to contest the matter before the Special Judge, TNPID Court and also failed to challenge the attachment. As regards the impugned communication, he submits that this is not even a sale notice.

4. On perusal of the paper book, it is clear that the proceeding to bring the property for sale was initiated pursuant to the judgment in O.S. No. 13 of 2019. Said judgment was pronounced on 25.11.2019. The petitioner has not filed an appeal against the said judgment. Pursuant thereto, the relevant property was attached. Said attachment has also not been challenged.
