ORDER

The present petition has been filed by the sole accused in S.T.C.No.798 of 2026, on the file of Learned Judicial Magistrate No.II, Kuzhithurai, Kanyakumari District, seeking to quash the charge sheet wherein he is charged with the offence under Section 292 of BNS, 2023.

2. A perusal of the charge sheet reveals that at about 1.30 P.M., on 02.04.2026, the petitioner is alleged to be standing in Munjirai Junction in a public place and giving nuisance to the general public and the students. Despite warning, he continued to create nuisance to the general public.

3. According to the learned counsel appearing for the petitioner, the charge sheet is vague in nature and does not specify the nature of the nuisance allegedly caused by the petitioner to the general public or to the students passing by. He further submitted that none of the witnesses cited in the charge sheet are members of the general public and that all of them are police officials. Therefore, he contended that the case is false. __________

4. The learned Government Advocate appearing for the respondent filed a detailed counter and contented that the petitioner was standing near the junction and was behaving in a disorderly manner and he was causing obstruction to the general public, school-going students and affecting the free flow of traffic.

5. Heard the learned counsel appearing for the petitioner and perused the material records of the case.

6. As could be seen from the charge sheet, the petitioner is charged with the offence of creating nuisance to the general public and the students while standing in the Munjiri Junction at about 1.30 P.M., on 02.04.2026. The nature of nuisance created by the petitioner is not mentioned in the charge sheet and it is completely vague in nature.

7. That apart, none of the general public has shown as one of the witnesses and all of them are police officials. __________

8. In such view of the matter, continuation of the criminal proceedings as against the petitioner herein would only be an abuse of process of law. Therefore, the charge sheet in S.T.C. No. 798 of 2026 on the file of Learned Judicial Magistrate No.II, Kuzhithurai, Kanyakumari District, is quashed.

9. Accordingly, the criminal original petition stands allowed. Consequently, connected miscellaneous petition is closed. 14-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No rgm __________
