ORDER

The present petition has been filed by A8 in S.C.No.67 of 2026 on the file of the Additional District Judge, Ramanathapuram District, seeking to quash the charge sheet, wherein the petitioner is charged with the offence under Sections 147, 148, 294 (b), 323, 324 and 307 of IPC.

2. A perusal of the records reveal that the petitioner herein along with seven others faced trial in S.C.No.209 of 2024, on the file of the Additional District Judge, Ramanathapuram District. This case was split up as against A4 and A8. The others faced the trial and they were acquitted on 20.08.2025, on the ground that witnesses have turned hostile as against A4 and A8 and the charge sheet was reassigned and numbered in S.C.No.67 of 2026.

3. Pending the trial, the complainant and the victim have entered into a compromise with A8. Today, both of them are present before this Court and they submitted that they have no objection for quashing of the charge sheet. __________

4. A perusal of the charge sheet reveals that there was no intention on the part of the accused persons to commit murder of the defacto complainant or the victim.

5. In such circumstances, invoking Section 307 of IPC would not be appropriate. Further, the other accused persons have undergone trial and they have been acquitted on the ground that the witnesses have turned hostile.

6. In such view of the matter, the charge sheet in S.C.No.67 of 2026, on the file of the learned Additional District Judge, Ramanathapuram District, stands quashed as against the petitioner herein.

7. Accordingly, the criminal original petition stands allowed. Consequently, connected miscellaneous petition is closed. The joint compromise memo shall form part and parcel of the order. 14-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No rgm __________
