PRAYER: It is therefore prayed that this Hon'ble Court may be pleased to direct the learned Judicial Magistrate, Uthamapalayam, to permit the petitioner to surrender before learned; Judicial Magistrate, Uthamapalayam ,upon such surrender and to recall the Non-Bailable Warrant issued against the petitioner in STC No.114 of 2025 and thus render justice.

ORDER
The present petition has been filed by the accused in STC No.114 of 2025, on the file of the learned Judicial Magistrate, Uthamapalayam, seeking a direction to recall the Non-Bailable Warrant issued on 24.04.2025.
2. According to the learned counsel appearing for the petitioner, notices were not served upon the petitioner and therefore, he could not appear before the Court on the relevant date and hence, an NBW has been issued.
3. Considering the above said facts, this court is inclined to pass the following order:-
a) The petitioner is directed to surrender before the learned Judicial Magistrate, Uthamapalayam, within a period of 10 days from the date of receipt of a copy of this order;
b) On such surrender, NBW issued on 24.04.2026, shall be recalled on the same day; __________

c) The petitioner is directed to co-operate and shall not seek for dispensing with his presence on future dates of hearing.
