2. The learned counsel appearing for the petitioner would submit that subsequent to the amendment of Section 149 of the Motor Vehicles Act, in the year 2019, a pay and recovery order against Insurer is not sustainable.
3. The issue raised by the petitioner has been considered by me in The Branch Manager, SBI General Insurance Company Limited Vs. Muthulakshmi and others reported in (2025) 1 TN MAC 597 and found against the Insurer. The said conclusion was affirmed by the Division Bench of this Court in The Branch Manager, ICICI Lombard General Insurance Company Limited and Others Vs. Mariyapushpam and others reported in Manu/TN/1553/2026. Since, the issue raised by the petitioner is already settled by the Division Bench of this Court, I am not inclined to entertain this Civil Revision Petition. Accordingly, the Civil Revision Petition is dismissed. Consequently, the connected Civil Miscellaneous Petition is closed. No costs. 14-10-2026 (3/3) Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No rya / ep
