ORDER
This civil revision petition has been filed under Article 227 of The Constitution of India against the order dated 25.9.2026 made in in I.A.No.2 of 2026 in O.S.No.4367 of 2026 on the file of the Third Assistant Judge, City Civil Court, Chennai (for short, the Court below) wherein, based on the application filed by respondents 1 and 2/plaintiffs seeking for an order of interim injunction, the Court below granted an order of status quo to be maintained till 06.10.2026.
2. Heard the learned counsel for the petitioner.
3. This Court has carefully considered the submissions of the

learned counsel appearing for the petitioner/D4 and the learned counsel appearing for respondents 1 and 2/plaintiffs and perused the materials available on record and more particularly the impugned order.
4. Respondents 1 and 2/plaintiffs filed the said suit seeking for the relief of declaration and permanent injunction. In the said suit, I.A.No.2 of 2026 was filed by respondents 1 and 2/plaintiffs under Order XXXIX Rules 1 & 2 of the Civil Procedure Code seeking for an order of interim injunction.
5. The petitioner/D4 filed a caveat in the said suit and the grievance of the petitioner is that in spite of the caveat being filed, the Court below, even without giving an opportunity of hearing to him, proceeded to pass the order of status quo on 25.9.2026 and it is being extended from time to time.
6. The grievance expressed by the petitioner is genuine and the Court below ought to have heard the petitioner before passing any order since the petitioner had already filed a caveat in this case

7. It is brought to the notice of this Court that I.A.No.2 of 2026 has been listed for hearing on 03.11.2026.
8. In view of the same, there shall be a direction to the petitioner to serve a copy of the counter in I.A.No.2 of 2026 to respondents 1 and 2/plaintiffs by 16.10.2026. The counter shall be filed before the Court below and there shall be a further direction to the Third Assistant Judge, City Civil Court, Chennai to hear I.A.No.2 of 2026 on merits and pass final orders within a period of two weeks from 03.11.2026.
9. The above civil revision is disposed of in the above terms. No costs. Consequently, the connected CMP is closed.
