WP No. 16154 of 2022

Mandamus, directing the 1st respondent to revise the scale of pay at Rs.4,100/- per month from 01.01.1984 together with all consequential service benefits.

2. Learned Special Government Pleader as well as learned Standing Counsel appearing for the 2nd respondent brought to the notice of this Court the letter dated 28.03.2017, wherein the 2nd respondent justified their action and has also passed an order to correct the pay fixation from 01.01.1996 and such order has also been enclosed along with the typed set of papers.

3. Learned Standing Counsel appearing for the 2nd respondent would also further brought to the knowledge of this court that this petitioner has also paid the excess payment and allowance occurred due to the wrong fixation as on 01.01.1996 and refunded a sum of Rs.78,678/- and remitted into the Government Accounts on 12.06.2017. The said submission of the learned standing counsel was not disputed by learned counsel for the petitioner. However, it is his submission that since the order dated 28.03.2017 is not elaborate, he has sent various representations to the respondents, however, those representations are still pending without consideration.

4. From the above submissions, it is relevant to cite the submissions made by learned Special Government Pleader appearing for the 1st respondent and learned Standing Counsel appearing for the 2nd respondent that orders in this

regard has already been passed on 28.03.2017. If at all, the petitioner is aggrieved with regard to the letter dated 28.03.2017, he is at liberty to agitate the same before an appropriate forum and seek for further clarification in accordance with law, if so advised.

5. In view of the above, this Court does not find any merit in the present Writ Petition. Accordingly the Writ Petition is dismissed. No costs.
