ORDER
The writ petition has been filed seeking the following relief : " To call for the records from the 2nd respondent pertaining to impugned order vide Ka.No.E.Mi.Poo/ E&PE/ Ka. Palayam/ Ko. Pukaar Manu/ en.145/ 22-23 dated 11.10.2022 and quash the same and consequently direct the 2nd respondent to install electric posts in front of the 3rd respondent's house and land which is situated Vandipalayam Road, Kondaiyampalayam, Varapalayam (PO), Nambiyur Taluk, Erode District-638 462."
2. The respondents 1 and 2 have filed their counter, in which, it has been stated as follows in paragraph Nos.13 and 14 : "13. I respectfully submit as could be seen from the averments of the petitioner that the poles are to be erected on the common Maavatta Saalai. Therefore, the petitioner has no right much less any legal right to

object to the laying of RCC poles on this state owned Maavatta Saalai. In such extension, there will be no damage to the coconut trees as alleged by the petitioner.
14. I respectfully submit that the works are as per Regulations of Electricity Act 2003 and provisions of Tamil Nadu Electricity Distribution code read with distribution standards of performance. As stipulated by the provisions of the Distribution Code and in consideration of least cost involved in extending supply, extension of supply has been proposed. In extending supply avoiding probable damages to the public water supply line, telephone cables and the age-old banyan tree are considered carefully. Further the work are on the common state owned Maavatta Saalai. As such the petitioner is estopped to interfere in the statutory duty of the respondents in extending electrical supply through this Maavatta Saalai."
3. A reading of the above, clearly indicates that the poles will not be erected in the property of the petitioner. Therefore, the petitioner cannot have any grievance to the electric poles being laid.
4. Recording the aforesaid undertaking given by the respondents 1 and 2, the writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed. 14-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No DS
