ORDER

The present writ petition has been filed seeking issuance of writ of mandamus to direct the 2nd respondent to forthwith settle the remaining retiral / terminal benefits of deceased B.Sundararaman to the petitioner based on the representation dated 02.06.2022.

2. When the matter was taken up for hearing, the learned counsel for the petitioner, in all fairness, accepted the calculation made by the respondents in Paragraph No. 7 of the counter affidavit filed by the 2nd respondent. For ready reference, Paragraph No. 7 of the counter affidavit is scanned hereunder:-

WP No. 31388 of 2024

3. According to the above calculation, the total eligible terminal benefits is Rs.17,87,771/- out of which, the respondents had deducted a sum of Rs. 5,68,758/- under various heads. Against which, the petitioner seeks liberty to initiate appropriate proceedings to challenge the same. After the above deduction, a sum of Rs.12,19,013/- is due to be payable by the respondents, out of which on various dates the respondents have disbursed Rs.5,00,000/- to the petitioner and in the balance of Rs.7,19,013/-, the respondents have paid Rs.2,00,000/- on 05-02-2025. Therefore, as on today, the balance payable to the petitioner is Rs.5,19,013/- and according to the counter statement, the 4th respondent society agreed to settle the above amount within two instalments.

4. In view of the above position, this Court directs the 3rd respondent to settle a sum of Rs.5,19,013/- to the petitioner in two equal instalments. The first instalment should be paid on 19.11.2026 and the second instalment should be paid on 30.11.2026.

5. In the light of the above observation, the writ petition stands disposed of. However, the petitioner is given liberty to challenge the deduction which had been made by the respondents in an appropriate proceedings in accordance with the law.
