Brief Facts:-
2. The petitioner would submit that she is the mother of the deceased Thiru. Velusamy, S/o. Subramaniyam, who died on 27.06.2023. The deceased was deaf and mute by birth, suffered from mental illness and, to the best of the petitioner's knowledge, remained unmarried during his lifetime.
3. The petitioner would submit that, after the demise of her son, she submitted an application dated 06.11.2025 before the competent Revenue Authorities, seeking the issuance of a Legal Heir Certificate, along with the relevant supporting documents.
4. The petitioner would submit that she had produced the Death Certificate, Smart Family Card, Aadhaar Cards, Legal Heir Certificate of the deceased's father, Police Clearance Certificate, FIR and other relevant records in support of her claim. However, the enquiry was conducted only on 10.08.2026, after a delay of approximately 277 days.
5. The petitioner would submit that, during the enquiry, the second respondent, Tmt. Selvamani, claimed to be the wife of the deceased. The petitioner disputed the said claim, contending that no marriage certificate, marriage registration certificate or other legally acceptable documentary evidence had been produced to establish the alleged marital relationship. The

petitioner would further submit that the Smart Family Card and Aadhaar Card of the second respondent do not reflect the deceased as her husband.
6. The petitioner would submit that, without properly considering the documents produced by her and the disputed claim of the second respondent, the Revenue Inspector rejected her application on 11.08.2026, followed by the impugned proceedings of the 1st respondent, in Na.Ka.No.3402/2025/A1, dated 14.08.2026.
7. The petitioner would submit that the impugned proceedings suffer from non-application of mind and that the rejection of her application without a proper enquiry into the rival claims is arbitrary and contrary to the principles of natural justice. Hence, the petitioner is before this Court seeking the reliefs stated supra.
8. Heard the learned counsel on either side and perused the records.
9. In the present case, the second respondent claims to be the wife of the deceased, Thiru. Velusamy, however, the petitioner disputes the said claim. The dispute as to whether the second respondent is the legally wedded wife of the deceased cannot be decided by this Court in exercise of its jurisdiction under Article 226 of the Constitution of India, as the same involves disputed questions

of fact, which can be adjudicated only by the competent Civil Court. Further, the first respondent, being the Tahsildar, is not the competent authority to decide the rights of the rival claimants. Hence, the first respondent has rightly rejected the application of the petitioner, and this Court finds no reason to interfere with the impugned proceedings.
10. Accordingly, the writ petition stands dismissed. The petitioner is at liberty to work out her remedy before the competent Civil Court. No costs. 14-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No SHR To The Tahsildar Annur Taluk, Coimbatore District,
