ORDER

This writ petition is filed for the following relief : “directing respondent Nos.1 and 2 to consider the petitioners representation dated 06.07.2026 and consequently direct Respondent Nos.1 and 2, jointly or separately, to issue the necessary No Objection Certificate (NOC) for enabling the issuance of patta in favour of the petitioners in respect of Town Survey No. 25 (Part), Block No. 48, measuring an extent of 532 ½ square feet, situated at Brindhavan Street, Puliyur Village, West Mambalam, Chennai – 600 033, and consequently direct the 3rd respondent, upon receipt of the NOC from Respondent Nos.1 and / or 2, to issue patta in favour of the petitioners in respect of the subject property within such time frame as may be fixed by this Court.”

2. With the consent of the learned counsel on either side, this writ petition is taken up for final hearing at the admission stage itself.

3. The petitioners submit that they are mother and son, claiming ownership and continuous possession of the property admeasuring 532 ½ sq.ft. at Plot No.4, Brindhavan Street, West Mambalam, Chennai, allotted to them under a registered Partition Deed of the year 2012. Despite their possession and payment of property tax and electricity charges, patta has not been issued. Pursuant to the order of this Court dated 08.06.2026 in W.P.No.18951 of 2026, the third respondent directed them to obtain an NOC from respondents 1 and 2, as the patta stands in the name of the Tamil Nadu Slum Clearance Board. Though the petitioners submitted a representation dated 06.07.2026 and the property was surveyed on 23.07.2026, NOC has not been issued. Hence, they seek a direction to the respondent Nos.1 and 2 to consider their representation and issue the NOC, followed by issuance of patta by the third respondent in accordance with law.

4. Heard the learned counsel on either side and perused the materials available on record.

5. Considering the relief now sought for by the learned counsel for the petitioners, this Court, without going into the merits of the case, directs the respondents 1 and 2 to consider the petitioners’ representation dated 06.07.2026 on merits and in accordance with law and to pass appropriate orders within a period of eight weeks from the date of receipt of a copy of this order.
