ORDER

This writ petition is filed for the following relief : “calling for the records pertaining to the impugned Lok Adalat Award Dated 09.07.2023 passed by the 2nd respondent and to quash the same as illegal, incompetent and ultra vires and consequently direct the respondent herein to restore the O.S No.51 of 2013 on the file of the learned Subordinate Judge at Uthangarai.”

2. With the consent of the learned counsel on either side, this writ petition is taken up for final hearing at the admission stage itself.

3. The petitioner submits that the properties mentioned in the affidavit filed in support of the writ petition are the ancestral joint family properties and that the Lok Adalat Award dated 09.07.2013 passed in

L.A.No.17 of 2013, arising out of O.S.No.51 of 2013, contains material irregularities, including omission of certain properties, inclusion of properties outside the suit schedule and duplication of survey numbers. As the Sub Registrar refused to register the settlement memo and no effective partition was effected, the petitioner has filed the present writ petition seeking to quash the impugned award.

4. Heard the learned counsel on either side and perused the materials available on record.

5. It is seen that the petitioner has already instituted a suit in O.S.No.597 of 2024, before the learned Principal District Judge, Krishnagiri, seeking partition, cancellation of the decree and for separate possession, and the same is pending adjudication. In view of the pendency of the said suit, this Court is not inclined to entertain the present writ petition.

6. Accordingly, this writ petition is dismissed, granting liberty to the petitioner to raise all the contentions urged herein before the Civil Court in the pending suit. No costs. 14-10-2026 Index: Yes/No Neutral Citation: Yes/No rap
