ORDER

This Writ Petition has been filed for the following reliefs:- "directing the respondents 2 to 5 to consider the representation dated 18.05.2026 submitted by the petitioners and consequently grant requisite permission/ NOC for redevelopment of the property situated at block No. 92, 7th Avenue, Besant Nagar, Chennai 90 within such reasonable time as may be fixed by this Honble court.

2. The petitioners would submit that they are the residents and flat owners of Block M.92, Tamil Nadu Housing Board Apartments, 7th Avenue, Besant Nagar, Chennai – 600 090. The said apartment building is more than 53 years old and is in a highly dilapidated condition, posing a serious threat to the safety and lives of its occupants. In view of the precarious condition of the building, the apartment owners have decided to undertake redevelopment of the property by demolishing the existing structure, in accordance with law. However, the redevelopment process has been stalled due to a dispute concerning the title to one of the flats, which is presently in the possession of the sixth respondent, thereby delaying the issuance of the No Objection Certificate by the Tamil Nadu Housing Board.

3. The petitioners would further submit that, in this regard, they submitted a representation dated 18.05.2026 to the second respondent, seeking the issuance of the No Objection Certificate for redevelopment of the subject property. However, the said representation has not been considered to date. Aggrieved by the inaction of the second respondent and the consequent delay in the redevelopment of the dilapidated building, the petitioners have been constrained to approach this Court seeking the reliefs stated supra.

4. When the matter came up for hearing, the learned counsel for the petitioners produced a copy of the order passed by this Court in W.P. No.11997 of 2023, dated 28.04.2023, wherein a similar direction was issued to the respondents in respect of similar relief. The learned counsel further submitted that, pursuant to the said order, the respondents had granted the requisite No Objection Certificate and permission for demolition for the purpose of redevelopment.

5. Heard the learned counsel on either side and perused the records.

6. Considering the facts and circumstances of the case and taking note of the fact that the relief claimed by the petitioners in the instant case has already been extended to some similarly placed persons by the respondents herein pursuant to the orders passed by this Court in W.P. No.11997 of 2023 dated

28.04.2023, the respondents 2 to 5 are directed to consider the petitioners’ representation dated 18.05.2026 and pass appropriate orders on merits and in accordance with law, in the light of the order passed by this Court in W.P.No.11997 of 2023, within a period of four weeks from the date of receipt of a copy of this order.

7. Accordingly, this Writ Petition is disposed of. No costs. Post the matter for reporting compliance on 30.11.2026. 14-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No SHR
