ORDER

(Order of the Court was made by S.M.Subramaniam J.) Letter addressed by the Tahsildar, Tiruthuraipoondi Taluk to the Inspector of Police, Aalivalam to provide protection for removal of encroachments in public street is under challenge in the present proceeding. Such internal communication between the Tahsildar and Inspector of Police for providing police protection per se would not provide a cause for institution of writ proceeding. Authorities had conducted a survey, identified encroachers in public street and thereafter, initiated enforcement action.

WP No. 42140 of 2026

2. Learned Government Advocate appearing on behalf of the respondents would submit that street encroachments are already removed with the assistance of the police. Under these circumstances the present writ petition is not entertainable.

3. Learned counsel for the petitioner would submit that common wall was constructed by the petitioner in his land.

4. If so, petitioner has to establish his civil rights before the competent Civil Court based on the documents and evidence available on record. However, present writ petition challenging the communication between the Tahsildar and Inspector of Police cannot be challenged, and more so, encroachments in public street had already been removed and that being the fact, the writ petition stands dismissed. No costs. Consequently, the connected miscellaneous petitions, if any, are closed (S.M.S.,J.) (R.R.V.,J.) 14-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No GD
