ORDER

This Writ Petition has been filed challenging the attachment notices dated 21.09.2026 issued under Section 226(3) of the Income Tax Act, 1961, by the first respondent to the fifth and sixth respondents herein.

2. Learned counsel for the petitioner submits that an appeal against the assessment order was preferred by the petitioner before the fourth respondent/appellate authority, which is presently at the stage of arguments. He further submits that under such circumstances, the first respondent has attempted to recover the disputed tax.

W.P.No.42417 of 2026

3. Learned Junior Standing Counsel appearing for respondents 1 to 4 submits that though a stay petition has been filed by the petitioner, no stay has been granted till date and therefore, the respondents were constrained to issue the impugned notices.

4. Heard the learned counsel appearing on either side and perused the materials available on record.

5. Considering the submissions made by the learned counsel on either side and taking note of the fact that the appeal has reached its final stage and now only requires arguments to be concluded, this Court is of the view that it would be appropriate to give quietus to the matter by directing the appellate authority to dispose of the petitioner’s appeal in a time bound manner.

6. Accordingly, there shall be a direction to the fourth respondent to dispose of the appeal filed by the petitioner in Appeal No.CIT(A), Coimbatore– 2/10562/2019-20 on merits and in accordance with law, preferably, within a period of six weeks from the date of receipt of a copy of this order. Till then, the respondents are directed to defer all further recovery proceedings pursuant to the impugned attachment notices.

W.P.No.42417 of 2026
