O R D E R
The petitioner, a Secretary of DD.548, Devagoundanpatti Primary Agricultural Cooperative Credit Society, Dindigul has been placed under suspension, by order dated, 25.09.2026. Challenging the same, this petitioner has filed this writ petition.
WP(MD) No. 29076 of 2026
2. The learned counsel for the petitioner has raised the following grounds:-
1. As an office bearer of the Employees Union, the petitioner has made a complaint against the Joint Registrar of Cooperative Societies/the second respondent. Therefore, this petitioner has been placed under suspension without any reasons.
2. In the complaint dated 30.06.2026, serious allegations have been made as against the second respondent, pursuant to which, an enquiry has also been contemplated. Apart from the complaint, dated 30.06.2026, there are several complaints against the second respondent.
3. Since this petitioner is also a signatory to the earlier complaint made by the Employees Union, dated 30.06.2026, this petitioner has been targeted by way of the order of suspension.
4. The order of suspension is without assigning any reasons for suspending this petitioner.
5. The petitioner has been placed under suspension, in order to
WP(MD) No. 29076 of 2026 coerce this petitioner to withdraw the earlier complaint against the second respondent and also to prevent him from adducing any evidence against the second respondent.
6. The respondents are attempting to find out some reasons in support of the order of suspension. Therefore, the learned counsel seeks interference of this Court in the order of suspension.
3. The learned Additional Advocate General appearing for the respondents states that a surprise inspection was conducted by the inspection team in the fourth respondent Society on 01.09.2026 and they have found a shortage of Rs.1,00,000/-. Therefore, an enquiry was contemplated as against this petitioner and he was placed under suspension.
4. In response to the submission made by the learned Additional Advocate General, the learned counsel for the petitioner
WP(MD) No. 29076 of 2026 submits that the amount of Rs.1,00,000/- was given as a jewel loan to one Lakshmi on 18.11.2025. He has also placed a receipt to that effect.
5. The learned Additional Advocate General, after perusing the jewel loan receipt submits that a mandatory direction has been issued to all Agricultural Co-operative Banks to issue computer-generated receipts. Otherwise, the transactions cannot be recorded in the accounts. He also pointed out that the bank is supposed to provide jewel loans at the rate of 7% rate of interest, whereas, in the receipt produced by this petitioner, the rate of interest has been mentioned as 12.5%. Therefore, according to him, it is obvious that this document has been created after the inspection. The learned Additional Advocate General, based on instructions, further submits that apart from this, the petitioner is also facing two surcharge proceedings.
WP(MD) No. 29076 of 2026
6. This Court has considered the rival submissions made on either side and perused the materials placed on record.
7. Admittedly, the petitioner, a common cadre employee, has been placed under suspension by the impugned order. There was an inspection in the fourth respondent Society and the inspection team found certain irregularities, based on which, the petitioner has been placed under suspension and disciplinary proceedings are also contemplated. The main contention of this petitioner is that no reasons have been assigned in the impugned order. He contends that for having lodged a complaint as against the second respondent, the petitioner was placed under suspension in order to prevent him from pursuing his complaint dated 30.06.2026 as against the second respondent. The petitioner claims that the alleged shortage amount of Rs.1,00,000/- is in fact given to one Lakshmi as a jewel loan, for which he produced a photocopy of the receipt, dated 18.11.2025. The learned Additional Advocate General has clarified that when
WP(MD) No. 29076 of 2026 there is a general direction to all the Co-operative Banks to issue computer generated receipts, the petitioner has issued the receipt manually, which is a violation of the Rules in vogue.
8. In view of the submissions of the learned Additional Advocate General, this Court is not inclined to interfere with the impugned order of suspension. Accordingly, this writ petition is dismissed. However, the respondents shall conduct the enquiry as against this petitioner in a fair and proper manner by providing an opportunity to this petitioner. The allegations made by the petitioner and the Employees Union against the second respondent shall also be addressed by the first respondent. The eligible subsistence allowance, if any, shall also be paid to this petitioner pending suspension. No costs. Consequently, connected Miscellaneous petition is closed. 14-10-2026 Index: Yes/No
