ORDER
This is the second round of litigation. The petitioner earlier approached this Court by filing W.P.(MD) No.25179 of 2026 for a mandamus directing consideration of the request for migration under the New Comprehensive Scheme. Said Writ Petition was disposed of by permitting the petitioner to challenge the order/communication dated 19.08.2026. Said order is challenged in this Writ Petition.
2. Learned counsel for the petitioner submits that the order/communication dated 19.08.2026 was issued without authority of law. He adds that the petitioner was not provided an opportunity before such order/communication dated 19.08.2026 was issued.
3. Mr.P.Pethu Rajesh, learned Additional Government Pleader, accepts notice for the respondents. He submits that the order/communication sets out cogent reasons for rejecting the petitioner's request. __________

4. On perusal of the order/communication, it appears to contain reasons for rejecting the petitioner's claim. It is, however, noticeable that the order has been issued by the Regional Transport Officer, who is not authorised to issue such order. There is also no indication that the petitioner was heard before such order was issued. For both these reasons, the impugned order is set aside and the first respondent is directed to consider the petitioner's request for migration and pass orders thereon within three
(3) months from the date of receipt of a copy of this order after providing a reasonable opportunity to the petitioner. For this purpose, the petitioner is permitted to represent the earlier application within 15 days from the date of receipt of a copy of this order.
5. This Writ Petition is disposed of on the above terms. There shall be no order as to costs. Consequently, the connected Miscellaneous Petition is closed. 14-10-2026 Index: No Speaking Neutral Citation: No JEN __________
