20.07.2026 passed by the 4th respondent and quash the same and consequently direct the respondents to treat the petitioners as having continued in service till his date of superannuation on 30.06.2026 and to settle and disburse all consequential monetary service and retiral benefits including back wages for the period from 18.12.2023 to 30.06.2026 with continuity of service and all attendant benefits.

ORDER
The petitioner, while working as a Branch Manager in a Co- operative Bank, was issued with a charge memo dated 10.04.2018 that he had wrongly sanctioned a loan to the tune of Rs.7,80,000/- to Women Self-Help Groups and also failed to recover the said loan amount, thereby caused financial loss to the Bank. Subsequently, he was imposed with a punishment of stoppage of increment without cumulative effect, by order dated 14.07.2021. In the meantime, a criminal case was registered against him for the offence under Section 409, 420, 422 and 120B IPC
WP(MD) No. 29616 of 2026 and the same was tried before the learned Judicial Magistrate No.II, Sivagangai, in C.C.No.39 of 2019, which ended in conviction, by Judgment dated 21.12.2022. Challenging the same, the petitioner filed a criminal appeal before the Additional District Court. Pending the criminal appeal, the 4th respondent, by order dated 18.12.2023, removed the petitioner from service, based on the conviction imposed by the trial Court. Challenging the same, the petitioner filed a writ petition before this Court in W.P.(MD)No.280 of 2024 and the same was disposed of by this Court with a direction to the petitioner to file a revision under Section 153 of the Tamil Nadu Co-operative Societies Act before the 1st respondent. The 1st respondent, by order dated 06.05.2026, remitted the matter back to the 4th respondent for fresh consideration. While so, the petitioner has attained the age of superannuation on 30.06.2026. However, the 4th respondent, by the impugned order dated 20.07.2026, confirmed the dismissal order passed against the petitioner. Challenging the same, the petitioner has filed this writ petition.
2. It is submitted that the petitioner is having an effective alternative remedy by way of appeal before the Joint Registrar of Co- operative Societies.

3. Therefore, this writ petition is closed with liberty to the petitioner to workout his alternative remedy by way of appeal before the Joint Registrar of Co-operative Societies. No costs.
