PRAYER: Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Mandamus, to direct respondents No.1 and 2 to survey the petitioner’s property situated in Survey No.136/2B1, Perumani Village, Thiruvarangam Taluk, Trichy District, admeasuring an extent of 2 acres 27¼ cents, and to fix its boundaries, with adequate police protection from the 3rd respondent within a period to be stipulated by this Court.

ORDER
The present Writ Petition has been filed in the nature of a Writ of Mandamus seeking for a direction to the respondents No.1 and 2 to survey the petitioner’s property situated in Survey No.136/2B1, Perumani Village, Thiruvarangam Taluk, Trichy District, admeasuring an extent of 2 acres 27¼ cents, and to fix its boundaries, with adequate police protection from the 3rd respondent within a period to be stipulated by this Court.

Heard Mr.A.Prabhu Raj, learned Counsel for the petitioner, Mr.I.Pinaygash, learned Special Government Pleader, who accepts notice on behalf of the respondents 1 and 2 and Mr.I.Murugesan, learned Counsel for State of Tamil Nadu, who accepts notice on behalf of the third respondent. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.
3. It is the case of the petitioner that he is the owner of the subject property and in order to survey and fix boundaries for the subject property, he has made an online application to the respondent authority on 29.07.2026. Since the said application has not been considered till date, the present Writ Petition has been filed seeking the aforesaid relief. __________

Considering the limited scope of prayer sought in the Writ Petition, this Court is inclined to issue the following directions: “The second respondent is directed to consider the application submitted by the petitioner on 29.07.2026 and pass appropriate orders on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order. If necessary, the second respondent can seek assistance of the third respondent at the time of surveying, who in turn, shall provide adequate police protection at the cost of the petitioner.
5. It is made clear that the order passed and the proceedings undertaken pursuant thereto would not confer any right to possession of the property if the same is in the hands of third parties.
