ORDER

The petitioner belongs to the Ayyampalayam village. Asserting that the annual festival of Arulmigu Periya Muthaalamman Temple involves five surrounding villages and that all five deity idols are placed at the Sadaiyandi Kovil Thinnai in Devarappanpatti village, the petitioner points out that the space available is not sufficient to conduct a joint Mudhal Poojai. After submitting representations in that regard, the present petition has been filed.

2. An impleading petition has been filed by one Ganesan. Ganesan asserts that the customary practice is that he makes the idols for worship during the festival and that he should be joined as a party to the writ __________

( Uploaded on: 14/10/2026 06:11:44 pm )

WP(MD) No. 29644 of 2026 petition because any orders passed therein would affect him. Considering the averments in the affidavit in support of the impleading petition, the impleading petition is allowed and the impleading petitioner is joined as the fourth respondent in the main writ petition.

3. Accepting notice for respondents 1 to 3, Mr.S.Iniyan Karthik, learned Government Advocate, points out that the idols are required to be made at Devarappanpatti in terms of the agreement recorded in that regard, whereas the fourth respondent/impleading petitioner made the idols at Ayyampalayam. This contention is controverted by learned counsel for the impleading petitioner, who submits that the idols were made at Devarappanpatti and are currently in Devarappanpatti village.

4. On perusal of the document recording customary practices, it is clear that the impleading petitioner's ancestors were entrusted with the task of making idols for this annual festival. At this juncture, the idols made by one Mani for Arulmigu Periya Muthaalamman Temple have not been placed in the Sadaiyandi Kovil Thinnai.

5. In the above facts and circumstances, this petition is disposed of on the following terms: __________

WP(MD) No. 29644 of 2026

(i) The idol made by Ganesan for Arulmigu Periya Muthaalamman Temple shall be placed at the Sadaiyandi Kovil Thinnai and thereafter taken to the temple.

(ii) All measures necessary to maintain law and order in relation to the annual festival shall be taken by the respondents in coordination with the jurisdictional police. There shall be no order as to costs. 14-10-2026 Index: No Speaking order Neutral Citation: No PKN __________
