PRAYER:
Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, calling for the records pertaining to the impugned refusal slip in Na.Ka. No.3036/APaB/2025-1 dated 23.10.2025 and quash the same as illegal and consequently directing the 2nd respondent to register the sale deeds if presented by the petitioners for registration.

ORDER
W.M.P.(MD)No.25158 of 2025 filed seeking for permission to file single writ petition is ordered accordingly.
2. Heard the learned counsel appearing on either side.
3. This Writ Petition is filed for issuance of a Writ of Certiorarified Mandamus, challenging the impugned refusal slip in Na.Ka. No.3036/APaB/2025-1 dated 23.10.2025 and quash the same as illegal and consequently directing the 2nd respondent to register the sale deeds if presented by the petitioners for registration.

4. Under the present impugned order, referring to the judgment and decree dated 28.04.2023 passed in O.S.No.265 of 2014, an order refusing the documents that stem from a partition deed dated 14.02.1986 was passed.
5. It is to be noted that an identical order came to be passed by the very same authority by proceedings dated 12.08.2024 in Na.Ka. No. 2688/AaBiBi/2024, which was challenged in W.P.(MD)No.24895 of 2024. By an order dated 21.10.2024, after analysing the issue, particularly in conjunction with the judgment and decree stated supra, this Court held that the purchasers of the property were entitled to claim equity even in respect of the shares allotted to the defendants in the suit. Therefore, this Court set aside the order impugned therein and directed the continuation of the registration of the subject properties.
6. When that be so, it is surprising that, contrary to the order passed by this Court and the directions issued in W.P.(MD)No.24895 of 2024, the present impugned order has been passed. This conduct of the 2nd respondent would amount to an abuse of the process of the Court, for which this Court could have also initiated suo motu contempt proceedings against the 2nd respondent. However, refraining from doing so, this Court is inclined to set aside the order passed by
WP(MD) No. 31970 of 2025 the second respondent, with a further direction to the first respondent to comply with the order passed by this Court in W.P. (MD) No. 24895 of 2024, dated 21.10.2024, and to advise the officers subordinate to it to exercise restraint in passing orders contrary to the decisions previously rendered by the Courts.
