ORDER

This Civil Revision Petition is filed challenging the order passed by the Executing Court attaching 4 buses of the Appellant Corporation in execution of the award passed by the Motor Accident Claim Tribunal.

2. It is seen from the records, the respondents herein filed a Motor Vehicles claim petition in M.C.O.P. No. 102 of 2018 seeking compensation for the death of one Jayabal, husband of the first respondent, father of respondents 2 and 3, and son of the 4th respondent. The said claim petition was allowed and the Appellant Corporation was directed to pay a sum of Rs.19,10,000/- together with interest and costs. Since the award amount has not been paid by the Appellant Corporation, the respondents filed an Execution Petition in E.P. No. 24 of 2024 on the file of the Special District Judge for MCOP cases, Villupuram.

CRP No. 1354 of 2026

3. It is seen from the records that, in spite of several opportunities, the Appellant Corporation failed to pay the award amount. Hence, ultimately, an order of attachment of 4 buses of the corporation was passed by the Executing Court by the impugned order. Aggrieved by the same, the petitioner has come before this Court.

4. The learned counsel appearing for the petitioner would submit that the petitioner corporation is running on loss and hence they find it very difficult to release the award amount and deposit the same before the Court. Therefore, the learned counsel seeks reasonable time for deposit of the award amount before the Executing Court. It is also stated that, pursuant to the interim order passed by this Court, 50% of the award amount together with interest has already been deposited before the Executing Court.

5. In the light of the submissions made by the petitioner, this Court is inclined to direct the petitioner to deposit the balance award amount to the credit of E.P. No. 24 of 2024 on the file of MACT, Special District Judge, Villupuram within a period of six weeks from the date of receipt of a copy of this order. Failing compliance with the condition, the Civil Revision Petition shall stand dismissed by affirming the order of attachment passed by the Executing Court.

CRP No. 1354 of 2026

6. In the event of failure on the part of the petitioner to comply with the directions, the respondents are at liberty to proceed with the execution of the award in the manner known to law in the Execution Petition in E.P. No. 24 of 2024 on the file of the Special District Judge for MCOP cases, Villupuram.

7. With the above said directions, this Civil Revision Petition is disposed of. Consequently, the connected Civil Miscellaneous Petition is closed. 13-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No rya To:-
