ORDER

The main contention putforth by the learned counsel for the petitioner is that the petitioner is eligible to have terminal benefits for more than Rs.40 lakhs whereas the respondent has paid only a sum of Rs.15,03,608.66/-. It is also the submission of the learned counsel for the petitioner that the subsistence allowance have not at all been paid besides other eligible dues.

2. However, the learned Additional Government Pleader appearing for the respondents 1 to 3 would contend that all the eligible dues to the petitioner has already been settled and there are no dues pending. It is also the contention of the learned Additional Government Pleader that the appropriate forum for the petitioner to challenge this issue is only the Revisional Authority under Section 153 of the Tamil Nadu Cooperative Societies Act, 1983.

3. This Court is in full agreement with the submissions made by the learned Additional Government Pleader for the respondents 1 to 3. At this juncture, the learned counsel for the petitioner seeks leave of this court to file a revision before the Revisional Authority under Section 153 of the Tamil Nadu Cooperative Societies Act, 1983. Further, he also seeks direction not to insist for a limitation while filing the revision petition.

4. I have given my anxious consideration to either side submissions and perused the materials available on record.

5. As rightly contended by the learned Additional Government Pleader, there is a disputed fact with regard to the quantum of the petitioner's entitlement. This disputed fact cannot be gone into in the writ proceedings.

6. In view of the submissions made by the learned counsel for the petitioner, the writ petition is disposed of giving liberty to the petitioner to approach the Revisional Authority under Section 153 of the Tamil Nadu Cooperative Societies Act, 1983 within a period of two weeks from the date of receipt of a copy of this order. If any revision is filed before the Revisional Authority within the above stipulated time, the Revisional Authority is directed to number the same without insisting for limitation and try to dispose of the same as expeditiously as possible.

7. With the above direction, the writ petition stands disposed of. Consequently, the connected miscellaneous petitions are closed. No costs. 13-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No NR
