ORDER

The present writ petition has been filed by the petitioner seeking to consider the various representation dated from 14.02.2022 to 02.09.2024. It is the specific submission of the petitioner that he was appointed by the 3rd respondent on 12.02.2022, however, the respondents 1 and 2 have not approved the appointment. Hence the petitioner is before this Court.

2. However, it is the submissions of learned Additional Government Pleader appearing for the respondents 1 and 2 that since the respondents 3 to 5 being a minority educational institutions, unless they send a proposal, respondents 1 and 2 cannot interfere in their internal administration to approve the appointment.

3. At this juncture, learned standing counsel for the respondent 4 and 5 would submit that the very appointment of the petitioner is illegal, as the then Bishop Rt. Rev. D.Daniel Jayaraj has made this appointment after his retirement, and such an alleged illegal action was challenged before this Court as well as before the Hon’ble Supreme Court and the Hon’ble Supreme Court found that such action of the Rt.Rev.D.Danie, Jeyaraj, is illegal and the said SLP was dismissed on 25.02.2022.

4. Learned counsel would further submit that even subsequent to the orders of the Hon’ble Supreme Court, the said Rt.Rev.D.Danie, Jeyaraj continued to do such appointments, which, the Hon’ble Madurai Bench, came down heavily upon the Bishop and also held in contempt of Court and ordered to pay a fine. Therefore, it is his submission that the question of sending the proposal to the 1st and 2nd respondent does not arise.

5. At this juncture, learned counsel for the petitioner would submit that no such communication was addressed to him. If any, communication is addressed to him, he would take proper legal course.

6. In such view of the above factual position, this Court, without going into the merits of this writ petition, directs the 4th and 5th respondent to consider the petitioner’s representation dated 02.09.2022 according to its own merits and in accordance with law and pass appropriate order within a period of four (4) weeks from the date of receipt of a copy of this order. No costs. Consequently, connected miscellaneous petition is closed. 13-10-2026 KAS
