ORDER

The present Writ Petition has been filed seeking a direction, to direct the respondents to dispose the representation made on 07.03.2022 and to issue a suitable government job to the 1st petitioner’s grand daughter S.Lalithambika.

2. Learned counsel for the petitioners would submit that the 1st petitioner was 87 years old freedom fighter and she is the grand mother of the 2nd petitioner. After the demise of the 1st petitioner, the 2nd petitioner who is a grand daughter was impleaded as a 2nd petitioner. Learned counsel for the petitioners would submit that the deceased 1st petitioner has already sent a representation dated 07.03.2022 to the respondents, requesting for a suitable job under the freedom fighters reservation to the 2nd petitioner, who is the grand daughter of the deceased 1st petitioner.

WP No. 21742 of 2022

3. Learned Special Government Pleader, strongly opposes this petition on the ground that as per G.O.Ms.No.59, Labour and Employment Department, dated 04.05.1999, orders were issued for giving priority to the legal heirs of the freedom fighters. However, vide the clarification letter issued by the Government on 02.03.2010, it is clarified that such freedom fighter reservation should only be provided to the sons and daughters of the freedom fighters and not to the grand sons and grand daughters. It is his submission that the 2nd petitioner being the grand daughter of the 1st petitioner, the question of seeking freedom fighter reservation does not arise.

4. I have given my anxious consideration to the submissions on either side and perused the materials placed on record.

5. The main contention put forth by learned counsel for the petitioners is that the deceased 1st petitioner, was a freedom fighter. There is no serious objection raised by the respondents in this regard. However, it is the contention of the learned Special Government Pleader that the deceased 1st petitioner has sought for a suitable job to her grand daughter under the freedom fighters reservation. In this regard, as rightly contended by the learned Special Government Pleader, the Government has come up with a clarification in G.O.Ms.No.59, vide clarification letter No.33413/T2/2009-3, Labour and Employment Department, dated 02.03.2010, that the freedom fighters

WP No. 21742 of 2022

reservation should only be availed only by the sons and daughters of the freedom fighters and not the grand sons and grand daughters.

6. In the present case on hand, the 2nd petitioner, who is admittedly a grand daughter and to whom the deceased 1st petitioner has sought for a suitable job. Hence, as rightly contended by the learned Special Government Pleader, such request cannot be granted, as the same is beyond the scope of the G.O.Ms.No.59 dated 04.05.1999. Accordingly, this Court is of the firm view that there are no merits in the present writ petition, to issue a Mandamus to consider the representation.

7. This Writ Petition stands dismissed accordingly. No costs. Consequently, connected miscellaneous petition is closed.
