ORDER

This Writ Petition has been filed for the following reliefs:- “Directing the 2nd respondent to consider petitioners my representation dated 07.10.2024, consequently extend all statutory compensation and rehabilitation benefits payable under rule 12(4) along with annexure I of the scheduled castes and scheduled tribes (prevention of atrocities) rules, 1995 including payment of the balance compensation, compassionate assistance, monthly pension along with arrears, government employment to one eligible family member, allotment of two acres of cultivable land, provision of a permanent concrete house.”

2. The petitioner would submit that he belongs to the Scheduled Caste community and that, in 2015, his minor daughter, aged about 16 years and suffering from a mental disability, was subjected to sexual assault. Based on a complaint lodged by the petitioner’s sister, the All Women Police Station, Polur, registered a case in Crime No.4 of 2015. Upon completion of the investigation, the case was taken on file by the Sessions Special Court for Exclusive Trial of POCSO Cases, Tiruvannamalai, in Spl.S.C. No.51 of 2020. By judgment dated 06.02.2023, the learned Special Judge convicted the accused under Section 6 of the Protection of Children from Sexual Offences Act, 2012, and Section 3(2)(v) of the Scheduled Castes and Scheduled Tribes (Prevention

of Atrocities) Act, 1989, and sentenced him to imprisonment for life for the remainder of his natural life.

3. The petitioner would further submit that his daughter is entitled to statutory compensation and rehabilitation benefits under Rule 12 read with Annexure I to the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Rules, 1995. Though she is entitled to compensation of Rs.7,00,000/-, including compassionate assistance, only a sum of Rs.90,000/- has been disbursed. The respondents have also failed to extend the other statutory rehabilitation benefits, including a monthly pension, Government employment to one eligible family member, allotment of two acres of cultivable land and provision of a permanent house. In this regard, the petitioner submitted a detailed representation dated 07.10.2024 seeking the disbursement of the balance compensation and extension of the other statutory benefits. However, despite receipt of the representation, the respondents have neither passed any orders nor extended the benefits sought for by the petitioner. Aggrieved by the inaction of the respondents, the petitioner has approached this Court seeking the reliefs stated supra.
