ORDER

The petitioner, working as a Computer Operator in the 3rd respondent Temple, has been dismissed from service, by order 06.08.2026. Challenging the same, the petitioner has filed this writ petition on the ground that the impugned order has been passed by the Board of Trustees, without conducting an inquiry.

WP(MD) No. 24674 of 2026

2. This Court, while entertaining this writ petition, considering the manner in which the petitioner has been removed from service and the allegations made by the petitioner as against the fourth respondent, granted an order of interim stay, by order dated 25.08.2026.

3. It appears that pursuant to the interim order, the petitioner has been allowed to continue in work.

4. A counter affidavit has been filed by the 4th respondent, wherein, he has stated that the petitioner is only a temporary employee and therefore, they have removed him from service without conducting an inquiry and they are prepared to conduct an inquiry against the petitioner.

5. However, the learned counsel for the petitioner has raised certain apprehension that the Board of Trustees, in order to accommodate another person in the place of the petitioner, is creating certain materials against the petitioner and attempting to remove the petitioner from service.

WP(MD) No. 24674 of 2026

6. This Court has entertained this writ petition on the ground that the petitioner has been dismissed from service without conducting an inquiry. Now, the 4th respondent has come forward to conduct an inquiry as against the petitioner.

7. Therefore, this writ petition is allowed and the impugned order of dismissal dated 06.08.2026 is hereby set aside. The respondents are permitted to conduct an enquiry against the petitioner. Since the petitioner has made certain allegations against the 4th respondent, an Enquiry Officer shall be appointed by the Joint Commissioner, HR&CE, Thoothukudi District. The petitioner is expected to co-operate for the inquiry. No costs. Consequently, connected miscellaneous petitions are closed. 13-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No ogy
