PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records of the proceedings of the 3rd respondent for auction dated 17.09.2026, quash the same as illegal, arbitrary, and without jurisdition, and consequently to directing the respondents 4 to 6 to take appropriate action against the respondents 7 to 11.

ORDER
An auction sale originally scheduled on 06.10.2026 for the removal of the Karuvelam trees is challenged in this Writ Petition and the petitioner seeks a consequential direction to the respondents 4 to 6 to take appropriate action against the respondents 7 to 11.
2. Learned counsel for the petitioner submits that the auction was cancelled after this Writ Petition was instituted. As regards the consequential direction, she submits that relief survives.
3. Mr.C.Deepak, learned Additional Government Pleader, accepts notice for the respondents 1 and 2. Mr.R.Mohamed Riyaz, learned Government Advocate (Crl.Side), accepts notice for the respondents 4 to
6.
4. On instructions, learned Additional Government Pleader for the respondents 1 and 2 submits that a fresh auction would be conducted later by issuing a notice in that regard.
5. Learned Government Advocate (Crl.Side) for the respondents 4 to 6 submits that an inquiry is going on with regard to the action against
WP(MD) No. 29194 of 2026 the respondents 7 to 11.
6. Any action against the respondents 7 to 11 shall be preceded by a reasonable opportunity to such persons. In view of this direction, this Writ Petition is being disposed of without notice to the respondents 3 and 7 to 11. The sixth respondent shall proceed with the inquiry strictly in accordance with law and conclude the same within three (3) months from the date of receipt of a copy of this order. If a fresh auction notification were to be issued, the petitioner is granted leave to challenge the same in accordance with law.
