PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court for issuance of a Writ of Mandamus directing the third to fifth respondents to take immediate statutory action to restrain and prevent the sixth respondent from carrying out any unauthorized and unlawful construction in the undivided ancestral property comprised in Old Survey No. 565/3 (New Survey Nos. 835/9B and 835/9C) situated at South Sankarankovil Village, Sankarankovil Taluk, Tenkasi District, without obtaining lawful partition, separate patta (Thani Patta) and valid statutory building plan approval from the competent authorities based on the petitioner's representation dated 25.09.2026.

ORDER
Mr.R.Parthiban, learned Special Government Pleader, accepts notice for the first, second and fifth respondents. Mr.S.Venkatesh, learned
WP(MD) No. 29262 of 2026 Additional Government Pleader, accepts notice for the third and fourth respondents.
2. Learned counsel for the petitioner submits that the unlawful construction is being proceeded with. He relies on photographs in this regard.
3. Learned Additional Government Pleader for the third and fourth respondents submits that notice was issued on 12.10.2026 for an enquiry in relation to the complaint made by the petitioner. He submits that the enquiry would be concluded after providing a reasonable opportunity to the petitioner, the sixth respondent and any other persons concerned.
4. Taking note of the above submissions of learned Additional Government Pleader for the third and fourth respondents, this Writ Petition is disposed of by directing the third and fourth respondents to conclude the enquiry and take necessary measures after providing a reasonable opportunity to the petitioner, the sixth respondent and any other person who would be affected by such decision. The process shall be concluded within a period of one month from the date of receipt of a copy of this order. There
