ORDER

The petitioner, working as a Driver in the respondent Transport Corporation, joined in the service on 04.08.2012. The qualification for the post of Driver is Higher Secondary Grade (+2). The petitioner was having the required qualification and he was appointed in the year 2012. Thereafter, he studied B.A.(History) and M.A.(History) and obtained degree certificates. The petitioner has submitted a representation to register the higher qualification of M.A.(History) degree in the service register. Since the petitioner’s representation has not been considered and his higher qualification of M.A. degree has not been recorded in the service register, the petitioner has filed this writ petition.

2. Mr.S.C.Herold Singh, learned Standing Counsel, takes notice for the respondents and submits that the petitioner did not obtain any

WP(MD) No. 29572 of 2026 permission for studying undergraduation. However, he fairly admits that the petitioner has obtained permission for pursuing his postgraduation in M.A.(History) and the Management, by order dated 11.12.2019, granted permission to the petitioner to pursue his postgraduation on certain conditions. According to the learned counsel, the petitioner has completed his undergraduation without permission of the management and the permission for pursuing the postgraduation is also on certain conditions. Therefore, the petitioner cannot claim it as a matter of right for recording his higher qualification in the service register.

3. This Court considered the rival submissions made.

4. The grievance of the petitioner is that his higher qualification of M.A. degree has not been recorded in the service register. It appears that the petitioner has been granted permission to pursue M.A. degree by order dated 11.12.2019. However, the Management has put some conditions in the order dated 11.12.2019, which is also extracted as under.

1. That the permission to study the Course will not if so-fact to confer any right on you for your continued posting in the present station or nearby the University area for the duration of the Courses.

WP(MD) No. 29572 of 2026

2. That pursuit of the Part-time Education study by you should be without detrimental to the efficient discharge of your official duties.

3. That the grant of permission will not entitle you to leave Office by any particular time every day. On occasions requiring your presence in Office beyond the office hours, you have to ungrudgingly stay in office till the time required.

4. That the Corporation will accept no liability for your failure to complete the percentage of compulsory attendance, prescribed for the course, if any, on this account.

5. That the permission to study the Post Graduate Degree course in M.A. (History) will not entitle you claim leave either for preparation or during the period of examination, if any required for the purpose will be sanctioned subject to title and exigencies of work and

6. That the Corporation reserves the right to withdraw the permission at any time without assigning any reasons.

7. You should not claim for higher position after obtaining Post Graduate Degree course in M.A. (History) Course, Qualification.

8. You should not claim transfer based on this permission.

5. It appears that the petitioner has not claimed any privilege on account of the degree which he has obtained. What he requires is only for

WP(MD) No. 29572 of 2026 entering his degree in the service register. Since this petitioner has already been permitted to pursue M.A. degree and he has also completed the postgraduation successfully, the same shall be recorded in his service register.

6. With the above observation, this writ petition is allowed. No costs. 13-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No ogy To
