ORDER

The petitioners are before this Court challenging the impugned refusal check slip issued by the respondent, dated 03.09.2026 and for a direction to register the settlement deed or sale deed or lease deed or any other deeds presented by the petitioners in respect of subject properties.

2. Heard Mr.K.Mahendran, learned Counsel for the petitioners and Mr.S.Siva Thilakar, learned Special Government Pleader, who accepts notice on behalf of the respondent. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.

3. A perusal of the impugned refusal check slip would indicate that the impugned refusal check slip had been issued pointing out that the death certificate of the original owner, namely, Ramasamy, had not been produced. However, perusal of the patta would indicate that the property, which have been purchased by Ramasamy, had been mutated in favour of his legal heirs. The petitioners are his grandchildren through one of the sons. Their mother had also died, which is substantiated by the death certificate produced whose name also shown in the joint patta holder.

4. When the revenue records have been mutated in the names of the legal heirs of the original owner of the purchaser, this Court is of the view that the reasons attributed in the refusal check slip is wholly incorrect and requires interference. Further, only if there is an order of civil Court restraining registration of the document, the same could be refused to be registered.

5. In the result, the Writ Petition is allowed and the impugned refusal check slip issued by the respondent, dated 03.09.2026 is set aside with a direction to the petitioner to reproduce the document and on such re-production, the respondent is directed to process the same in accordance with law. There shall be no order as to costs. 13-10-2026 Index: Yes/No (1/2) Speaking/Non-speaking order Neutral Citation: Yes/No cmr To The Sub Registrar Sub Registrar Office, Srirangam, Trichy District.
