ORDER

The petitioner is before this Court challenging the impugned refusal check slip issued by the respondent, dated 13.08.2026 and for a direction to register the sale deed presented by the petitioner in respect of subject property.

2. Heard Mr.M.Anbarasan, learned Counsel for the petitioner and Mr.I.Pinaygash, learned Special Government Pleader, who accepts notice on behalf of the respondent. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.

3. A perusal of the impugned refusal check slip would indicate that the impugned refusal check slip had been issued pointing out that even though the patta stands in the name of the petitioner’s vendors, the order transfer of patta does not reflect as to how the patta was transferred in the name of the petitioner’s vendor from one Adaikkan son of Kuppamuthu.

4. However, this Court is of the view that the ground stated in the refusal order cannot be legally accepted as the registering authority has no jurisdiction to sit in appeal over the order of the Tahsildar / Revenue

Divisional Officer transferring patta. The validity of patta can be questioned only before the competent Revenue Appellate Authority and not by the Sub Registrar.

5. In such view of the matter, the impugned refusal check slip issued by the respondent, dated 13.08.2026 is hereby quashed. The respondent is directed to register the document presented by the petitioner, if it is otherwise in order.

6. With the above directions, the Writ Petition stands allowed. No costs. 13-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No cmr To The Sub Registrar Office Of The Joint Sub-registrar-I, Pudukkottai Pudukkottai District.
