PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of CERTIORARIFIED
MANDAMUS to call for the records pertaining to the impugned order passed by the 1st respondent in Na.Ka.COLR-14661-2023-H1 dated 10.10.2025 and quash the same and consequently directing the respondents to take appropriate steps to rectify the classification and issue patta to the petitioners house situate in S.F.No.1537/7 of NaranapuramPart-1 Village, Sivagiri Taluk, Tenkasi District in the light of the 3rd respondents proceedings in SVGREV/1579/2023-B2 within the time stipulated by this Court.

(Order of the Court was made by G.R.Swaminathan J.) Heard both sides.
2. The petitioner questions the impugned order passed by the District Collector, Tenkasi calling upon him to remove the encroachment said to have been committed by him. __________

3. The specific stand of the private respondent is that the petitioner has encroached upon a street.
4. Since there are too many factual aspects, we are unable to go into the same in exercise of our jurisdiction under Article 226 of the Constitution of India. It is seen that the petitioner has filed O.S.Nos.226 of 2022 and 34 of 2024 on the file of the Sub Court, Sankarankovil seeking declaratory relief. We direct the petitioner herein to implead the private respondent herein in the said suits. We make it clear that we are not interfering with the impugned order. We only direct that it shall abide by the outcome of the suits. The parties shall place their respective cases before the jurisdictional civil court. If necessary, even an Advocate Commissioner can be appointed at the cost of the petitioner herein. Considering the special facts of this case, we direct the Court below to dispose of the suits on merits and in accordance with law within a period of eight months from the date of receipt of a copy of this order. If the petitioner succeeds, the impugned order will go. If the petitioner fails, the impugned order shall be enforced. The question of giving a further revisional remedy to the petitioner will not then arise. The Court below can combine both the suits and jointly try them. __________
