PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the respondents 1 to 4 to remove the encroachment made by the 5th and 6th respondents in branch of Ananthanar Channel in Bhoothapandi Village, Thovalai Taluk, Kanyakumari District in R.S.Nos.110/41, 109/9 and 123/9 on the basis of the petitioners representation dated 30.10.2025.

ORDER
(Order of the Court was made by G.R.Swaminathan J.) The Petitioner is a resident of Thittuvilai, Boothapandi. He alleges that there are encroachments in the petition mentioned survey numbers. He wants the same to be removed. Since his representation dated 30.10.2025 did not yield any action, he had to knock the doors of this Court.
2. When the matter was taken up for hearing, the learned Government Advocate submitted that Survey Nos.110/41 and 123/9 have been classified as “public channels”. According to them, all the __________

WP(MD) No. 35558 of 2025 encroachments in the said survey numbers have been totally removed. The said submission is placed on record. As regards Survey No.109/9, it has been classified as “Boosthuthi Padhai”. It is submitted that most of the encroachments therein have also been cleared. However, two houses have been spared because the encroachments were too insignificant and that if any adverse action is taken, the entire house may come crumbling down. This stand is also recorded.
