PRAYER: This petition is filed under Section 528 of BNSS to call for the records in connection with P.R.C.No.50 of 2026 on the file of the learned District Munsif Cum Judicial Magistrate, Ottapidaram, Thoothukudi District in Crime No.45 of 2026 on the file of the Inspector of Police, Puthiyamputhur Police Station, Thoothukudi District and consequently, quash the same as illegal and devoid of merits.

ORDER
The present petition has been filed by A3 in PRC No.50 of 2026 on the file of District Munsif Cum Judicial Magistrate, Ottapidaram, Thoothukudi District, seeking to quash the charge sheet, wherein the petitioner, along with others are charged with the offence under sections 468, 420, 465, 467, 469, 471, 204 r/w 109 and 34 IPC.
2. Perusal of the charge sheet reveals that the petitioner herein was engaged by A4 to A6, who were Fleet owners to get insurance policy for the vehicles. The petitioner is said to have received a sum of Rs.10,000/- and issued alleged fake policy for a premium amount of Rs.52,000/-.
3. According to the learned counsel appearing for the petitioner, the entire allegations are only as against A1 and A2, who are said to have created a fake insurance policy and except introducing A1 and A2 to A4 to A6, no other allegation levelled as against the petitioner.
4. According to the learned Additional Public Prosecutor appearing for the first respondent, the mail ID in the fake insurance policy is that of the petitioner, and therefore, the petitioner very well __________

CRL OP(MD) No. 23174 of 2026 know that for a sum of Rs.10,000/- premium is not sufficient for a lorry for one year.
5. Heard the learned counsels on either side and perused the materials available on record.
6. As could be seen from the charge sheet, specific overt acts are alleged as against the petitioner and the petitioner’s mail ID is shown as the contact address in the fake policy. In such circumstances, this Court is not inclined to accept the contentions of the learned counsel appearing for the petitioner.
7. In view of the above facts, there are no merits in the petition. Accordingly, this Criminal Original Petition stands dismissed. However, the personal appearance of the petitioner shall stand dispensed with, unless specifically directed by the trial Court.
