ORDER

The present petition has been filed by A4 in STC No. 120 of 2025 on the file of learned Judicial Magistrate, Theni seeking to quash the charge sheet, wherein, the petitioner is charged with the offence under Sections 143, 341, 353 of IPC.

2. Perusal of the charge sheet reveals that the petitioner and others, who belong to Tamil Nationalist Marxist Party are said to have unlawfully assembled at 8 P.M., on 11.02.2024 and put up a flex banner, seeking to introduce Tamil as an official language in the High Court. The petitioner herein and others are said to have threatened the police officials and prevented them from performing their duties and they are also alleged to have threatened that they would set fire to the vehicles if they are not permitted to protest.

3. According to the learned counsel appearing for the petitioner, it was a democratic form of protest seeking introduction of Tamil as an official language in the High Court, therefore, a false complaint has been lodged. He further contended that none of the general public have been examined.

CRL OP(MD) No. 23192 of 2026

4. Heard the learned counsel appearing for the petitioner and perused the materials available on record.

5. As could be seen from the charge sheet, the petitioner and others, who belong to an Organization have said to have unlawfully assembled at about 8 A.M., on 11.02.2024 and protested for not introducing Tamil as an official language in the High Court, and as far as the other allegations are concerned, all the listed witnesses are police officials. In such circumstances, continuation of criminal proceedings as against the petitioner herein would only be an abuse of process of law. The other accused persons also stand on the same footing.

6. In such view of the matter, the charge sheet in STC No.120 of 2025 on the file of Judicial Magistrate, Theni stands quashed not only as against the petitioner, but also as against the other accused persons.

CRL OP(MD) No. 23192 of 2026

7. Accordingly, this Criminal Original Petition stands allowed. Consequently, connected miscellaneous petitions are closed. 12-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No PNM To
