ORDER

The present petition has been filed by A3 in CC NO.952 of 2023 on the file of Judicial Magistrate No.V, Madurai, seeking to quash the charge sheet wherein the petitioner is charged with the offence under Sections 120(b), 414 of IPC.

2. Perusal charge sheet reveals that the petitioner is said to be in contact with the A1 and A2 in receipt of stolen jewellery.

3. According to the learned counsel appearing for the petitioner, since the petitioner was illegally detained by the respondent police, the petitioner was forced to file a Habeas Corpus Petition before this Court. Out of vengeance, several cases are being filed as against the petitioner herein and, therefore, this is a false case.

4. Heard the learned counsel appearing for the petitioner and perused the material records.

5. As could be seen from the charge sheet, the petitioner is a Jewellery Shop Owner and he is said to have received stolen jewellery from A1 and A2. Since there are specific overt acts alleged as against the

CRL OP(MD) No. 23277 of 2026 petitioner herein, this Court is not inclined to entertain the quash petition. That apart, out of 20 witnesses, already 3 witnesses have been chief and cross examined.

6. In such view of the matter, there are no merits in the petition. Accordingly, this Criminal Original Petition stands dismissed. There shall be a direction to the learned Judicial Magistrate No.V, Madurai to dispose of the case on or before 31.03.2027. Consequently, connected miscellaneous petition is closed. 12-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No PNM To
