ORDER

The Civil Revision Petition is filed challenging the order passed by the Sub Court, Sankarapuram, in E.P.No.151 of 2025 in O.S.No.161 of 2016.

2. The respondent herein filed a suit seeking recovery of compensation from the petitioners / Electricity Board. The said suit was decreed on 31.01.2025, directing the petitioners / Electricity Board to pay a sum of Rs.9,60,906/- together with interest at the rate of 9% per annum. The said decree is put into execution in E.P. No. 151 of 2025. The Executing Court, by the impugned order passed an attachment order against the movables of the petitioners / Electricity Board. Aggrieved by the same, the petitioners had come before this Court.

3. The learned counsel appearing for the petitioners would submit that, challenging the decree passed by the Trial Court, the petitioners preferred an appeal before the Appellate Court with a delay. In the meantime, an attachment order has been passed by the Executing Court. The learned counsel for the petitioners is not in a position to disclose the details of the appeal filed by the petitioners before the first Appellate Court.

CRP No. 6533 of 2026

4. It is seen from the typed set of papers that the decree was passed against the petitioners on 31.01.2025. If the first appeal is already preferred by the petitioners, it is for them to work out their remedy by seeking necessary interim order from the first Appellate Court after condonation of delay. Since there is no stay by the first Appellate Court, the Executing Court rightly proceeded with E.P.No.151 of 2025 and passed the attachment order. Therefore, this Court is not inclined to entertain this Civil Revision Petition.

5. Accordingly, this Civil Revision Petition is dismissed. No costs. Consequently, the connected miscellaneous petition is closed. 12-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No rya / ep To:- The Subordinate Judge, Sankarapuram.
