Order

(Order of the Court was made by S.M.Subramaniam J.)

This writ of Mandamus has been instituted to direct the Respondents to constitute a Committee to determine the basis on which the patta was issued in the Schedule 1 mentioned serial Numbers on areas designated as water bodies in Ulleripattu, cuddalore district.

2. The Zonal Deputy Tahsildar, Cuddalore filed a counter affidavit stating that Bahur Eri (lake) is situated in Survey No.42 in Ulleripattu Village, Cuddalore District and during the re-survey of the lands in Survey Nos.37, 38, 39, 40 and 41 classified as Ryotwari Punjai lands were recognised as Patta

WP No. 35477 of 2019

lands. Necessary changes have been made in the 'A' Register of Ulleripattu and the Village Administrative Officer also submitted that, after 1972 no Pattas were issued to anybody with respect to the said survey numbers.

3. Bahour Eri is situated in an extent of 62.00.5 Hectares in Survey No.42 (Old Survey No.183), Ulleripattu Village, Cuddalore Taluk, Cuddalore District. One part of the said Eri is within the limits of Puducherry Union Territory and one part is situated within the territorial limits of the State of Tamil Nadu. The Eri is being maintained by Puducherry Union Territory and adjacent to the said lands, the lands in S.Nos.37, 38, 39, 40 ad 41 of Ulleripattu Village are situated as per the revenue records.

4. Pertinently, during the resettlement survey conducted in the year 1972, Pattas were granted in favour of persons who were in occupation and identified as poor landless persons. The Resettlement scheme was implemented in the year 1972. After re-settlement the Pattadars are in possession for more than 46 years and even prior to the Resettlement scheme, they were found to be in possession of the said area. The welfare government has taken a policy decision to grant Patta while implementing the Resettlement scheme. Dislocation of those persons at this length of time is

undesirable. The Government would have granted Pattas based on terms and conditions and that being the factum, the present writ petition filed for constitution of a committee to determine the basis on which the Patta was issued in the year 1972 need not be undertaken.

5. For the above reasons, the writ petition stands dismissed. No costs. Consequently, connected miscellaneous petition is closed. (S.M.S.,J.) (R.R.V.,J.) 12-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No KST
