ORDER
The present writ petition has been filed seeking the relief under Section 24(2) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (hereinafter referred to as “the Act, 2013” for brevity).
2. A Constitution Bench of the Hon’ble Apex Court had interpreted Section 24(2) of the Act, 2013 and had held that anyone of the contingencies viz., the deposit of the amount before the appropriate Court or the possession of the lands had been taken, then Section 24(2) of the Act, 2013 could not be invoked to hold that the proceedings under the Land Acquisition Act had lapsed. It had categorically held that twin conditions should subsist for invoking the powers under Section 24 of the Act, 2013 for declaring the land acquisition proceedings as lapsed.
WP(MD) No. 1200 of 2018
3. In the present case, an award came to be passed and pursuant to the orders of this Court in W.P.(MD) No.5163 of 2009, dated 01.09.2009, the award amount of sum of Rs.5,61,094.50 had been deposited with the learned Subordinate Judge, Madurai vide Cheque No.“107807”, dated 31.03.1989. In such view of the matter, this Court is of the view that by application of the judgment of the Hon’ble Apex Court, this Court would not be entitled to declare the land acquisition proceedings as lapsed.
4. Accordingly, this Writ Petition fails and the same is dismissed. There shall be no order as to costs. Consequently, connected miscellaneous petitions are also dismissed. 12-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No ABR
